On Friday, October 21, Protect PT attended proceedings at the Westmoreland County Court of Common Pleas where the township requested a stay on activity of the three Level Green sites that were "deemed approved" by Apex in August because Protect PT filed an appeal to those approvals. The judge decided to grant a temporary stay until the court can hear evidence at a hearing scheduled in December. Protect PT attorney, Ryan Hamilton of Fair Shake Environmental Legal Services stated, "There is something important about community participating in these hearings and with the deemed approvals the community lost that opportunity." The township has petitioned the court to intervene in that appeal and stand by their belief that "Apex, by its conduct, explicitly granted extensions to the township."
Apex alleged that the ZHB "wrongfully and illegally denied" their three applications (Beattie, Draftina, and White) which they are currently appealing at the county as well. Protect PT, along with potentially aggrieved landowners are attempting to intervene to support the Zoning Hearing Board’s decisions as we feel the decisions were warranted. Oral argument for our intervention status is scheduled for November 29th.
