NEWS ALERT: Protect PT Opposes Apex’s Newest Tactic

On August 25th, 2016 Protect PT learned through it’s legal team at Fair Shake Environmental Legal Services, that Apex Energy LLC, the unconventional natural gas developer focused on developing 7 unconventional gas well pads in Penn Township submitted a legal notice to the Penn-Franklin News notifying the township and its residents that Apex is deeming their special exception applications approved, without a public hearing on these applications at the Zoning Hearing Board. According to the notification, Apex alleges that the “Penn Township Zoning Hearing Board failed to commence a hearing on the applications” of well pads Numis, Drakulic, and Deutsch all located in the Village of Level Green.

“This is just another example of Apex misleading and bullying the township and residents in order to get the results they want, ” said Gillian Graber, President Protect PT.  “The way Apex operated the Quest well in Penn Township, the way residents felt bullied at the Zoning Hearing Board hearings and Apex’s filing of a federal lawsuit, these are all examples of their relentless tactics to achieve their desired results. This is another reason why Penn Township needs to eliminate the Mineral Extraction Overly and affirmatively limit unconventional gas development, a heavy industrial process, to industrial areas,” said Graber.

Protect PT believes there was an understanding between Apex and the township as to how they would proceed with tackling the 7 applications that Apex submitted in November of 2015. The township gave Apex the opportunity to schedule additional hearings to accommodate the developer’s needs. Yet, it seems Apex is now attempting to take advantage of the accommodations provided by the township simply for the benefit of commencing their industrial activity.  


Protect PT will continue working to ensure that protections for the residents of Penn Township and the neighboring communities are upheld in order to make the community a safer, healthier place to live.
